Baxters of Linstead Magna and Parva

Linstead Magna and Parva

Linstead Magna was a small village of scattered houses that no longer exists, which laid between four and five miles from Halesworth. The church was dedicated to St Peter and was in the center of the village. The only reference on the map now to Linstead Magna is Church Farm near Linstead Hall. Linstead Parva is also situated between four and five miles from Halesworth where houses are built round three greens. The church is dedicated to St Margaret, is small with a belfry. Both parish registers date back to Tudor times.

Thomas Baxter (1776 - 1849)

Thomas's origins are currently unknown however it seems likely that he was a relation of Kerenhappuch (Happy) Baxter (1775 - 1797) who is buried in Linstead Parva on the 10th January 1797 a single woman aged 22.

Marriage

Thomas married Ann Rackham (1781 - 1854) the daughter of Stephen Rackham and Mary Baldry on the 12th October 1802, Cratfield.

The Ipswich Journal 01 Jul 1854
Inquest - On Thursday at Linstead Parva, on the body of Ann Baxter aged 73.  The deceased strangled herself by placing her head in a noose of a handkerchief, the ends of which were fastened to a nail.  Evidence of insanity having been given, the jury returned a verdict to that effect.

Hepzibah Baxter (1805 - 1880)

Marriage

Hepzibah married Nelson Smith (1806 - 1888) the son of James Smith and Sarah Gibbon. From the parish registers of Linstead Parva:

Thomas Baxter (1810 - 1886)

Thomas moved from Linstead Parva and settled in Ipswich.

H. Paddall Wangford v E Baxter and S Plumb – Action to recover the value of a pig.
Plaintiff said that on the 19th of October he went out with his wife and family and left him man W Baxter (Linstead) to mind the premises.  While he was away the two defendants came to his house and took a fat pig out of the sty, he went to Baxter’s the next morning about it, but found it was killed and the two defendants had taken it to Lowestoft.  He left word with Baxter’s mother that if he did not come and make arrangement he should enter an action against him.
Wm Baxter* plaintiff’s man said the defendants came and took the pig while his master was out, but although left in charge he did not consider it any concern of his.
The defendant Plumb, said he was authorised by plaintiff to sell the pig, and sold it to Baxter for £4 10s.  The money was left with a woman in charge.
Plaintiff denied authorising defendant to sell the pig for him and said the money was never given him by the woman of the house.
The defendant Baxter said he went with Plumb and bought the pig of him for £4 10s.
His Honour said they had no right to take the pig away in Plaintiffs absence and gave judgement for £5 to be paid in 14 days.

Robert Bryanton, Robert Warner, Richard Segsby, Henry Segsby, James Baxter, Henry Tacon, William Chandler, Charles Wright, Samuel Freeman, and William Segsby, labourers; Arthur Girling, carpenter; Henry Balls and James Balls, blacksmiths, all of Cratfield, were charged with being on the above premises on the same day during prohibited hours. – All pleaded guilty except Wright and W. Segsby, and each were fined 14s, including costs, or seven days.  Six paid, and time was allowed to the others. – The charge against Wright and Segsby was dismissed.- Mr. Tuck defended, by whose advice the defendants pleaded guilty.

SERIOUS CHARGE AGAINST CRATFIELD LABOURER
A Home Of Filth
At Halesworth Session on Thursday, before F. F. Badington Esq (chairman), and A. J. Smith, Esq., James Baxter, labourer, Cratfield, was charged with cruelty to his child. Rosa Baxter, aged 13, by neglecting her in such a manner as to prejudice the child's health. Defendant, said Mr. Cowl, the prosecuting solicitor, was a widower, and the girl had been sleeping in the same bedroom as her father, under circumstances which were of a revolting character. The bedroom was in an almost indescribably filthy state, and was not fit for human habitation. Mr. Cowl explained that the girl was subject to fits, and under these circumstances it was very necessary the girl should have the best possible surroundings. The medical gentleman who had seen the girl at the request of the Society's Inspector, was of the opinion that the conditions under which the girl was living were likely to contribute to a frequent recurrence of the fits. This girl when examined was in a verminous and filthy state. The defendant had been well able to support his child, but had preferred to spend his earnings, amounting to 13s a week, mostly in drink. Defendant always returned home in a state of intoxication, and his daughter suffered thereby. Inspector Crawley, in a detailed description of defendant's home, which was in a horrible state of neglect, said it was apparent no attempts had been made to cleanse the place for months. Everywhere was filth and dirt, and the stench that was produced in consequence was unbearable, not only to anyone entering the house, but even to defendant's next door neighbour, who had been compelled to make complaints. The defendant had no excuse to offer, and pleading guilty, was sentenced to a month's hard labour.

George Ernest Newman, Harry Peek, and William Beckett, all of Halesworth, were charged with having, on the 22nd inst., feloniously stolen half a pint of gin, half a pint of brandy, and five ounces of tobacco, the property of Robert Buxton(sic), of Halesworth, innkeeper. – Prisoners were all in the bar on the day named, at about three o’clock.  At that time the bar door had been locked by Baxter, his wife being absent at the time.  The prisoners left the bat and came into the kitchen and had some beer and left the house.  Baxter shortly after found the bar door open, and noticed the handle off the cash drawer.  On the wife’s return she missed the gin, brandy, and tobacco.  Information was given to the police, and the prisoners were apprehended and tobacco found upon Newman and Beckett, and Peek went into the stable at the Angel, and afterwards tobacco was found in a manger therein, answering the description of that lost from Baxter’s house.  They could give no account for the possession of it, and all were found guilty, and sentenced to a month’s imprisonment with hard labour.

Read, Woods, Rumsby, A. Felgate, and H. Short.

At Norwich last night an ex-soldier named Jas. Cook of Saxmundham, after taking his sweetheart, Ellen Baxter, a cook, out for a walk, shot her twice in the back of her head with a revolver on reaching her employer's garden, and afterwards shot himself himself. The shots were heard by the family, who found both lying dead on the garden path. The girl had given notice to leave her employment, and was to be married to Cook in April. Cook went through the South African war and was thrown from his horse, undergoing three operations. It is stated he had been discharged from his situation at Saxmundham on Monday.

INQUEST AND VERDICT
The coroner's jury at Norwich on Friday viewed the bodies of Ellen Baxter and James Everett Cook, victims of the terrible tragedy at Norwich on Wednesday evening. Evidence showed that the couple had been keeping company for a considerable time and were contemplating marriage. Cook had served in the war in South Africa, and whilst there met with a serious accident which necessitated certain operations. Since his return to England he had been living at Saxmundham, and paid weekend visits to Norwich. He went there last Saturday, left on Monday, and returned again on Wednesday. At that time there was a strangeness about his manner. The couple went out in the evening, and about ten o'clock reports of firearms were heard, and a little later the two were found lying dead in the garden of the girl's employer. The evidence showed that the man had not been discharged from his place of employment. He suffered from alternate fits of excitement and depression. A verdict of "Wilful murder and suicide while temporally insane," was returned.

An inquiry has been held concerning the death of Ellen Baxter, a cook in a gentleman's family, and James Everitt Cook, navvy and ex-soldier, living at Saxmundham, whose dead bodies were found on Wednesday night last week in the grounds of Baxter's employer in Newmarket-Road, Norwich. Cook had visited his sweetheart and had gone for a walk with her. On returning at ten o'clock at night he shot her in the head from behind, and then put three bullets through his own head. There were no signs of a struggle and no evidence as to the motive, for the parties had been on the best of terms. It was stated that Cook had been sometimes strange in his manner since he returned from Africa, where he was in the Field Artillery. He had had enteric fever, and an accident that necessitated three operations. Over £10 were found in his pockets

Scene At The Funeral Of The Murdered Girl
It would not be possible to realise a sadder or more touching scene than, that which was witnessed in the village of Badingham, near Framlingham, on Sunday afternoon last, when the body of Ellen Baxter, the victim of the first of the two recent Norwich murders, was interred in the Churchyard. The remains had been conveyed from Norwich to the home of the deceased girl's parents at Badingham on the previous day.
The route from the humble village home so ruthlessly plunged into grief to the church - a distance of nearly two miles - was lined on either side with sorrowing parishioners: those who had known the parents as respectable and hardworking people and had lived amongst them and their children all their lives, and those of later years who, with Ellen Baxter and her brothers and sisters, had worked and played side by side in the village school.
An ordinary two-wheeled vehicle, in accordance with a primitive custom still in vogue in many villages, served the purpose of a bier; the grief stricken parents and seven brothers and sisters of the deceased girl followed immediately behind in similar conveyances, those lining the route closing up in the rear as the cortege proceeded.
The coffin was met at the church gates by the Rector, Rev. Foster S Barry, who conducted the service. The scene at the graveside was pathetic in the extreme, the relatives of the poor girl sobbing piteously, while many of the assembled throng were also moved to tears.
Amongst the wreaths was one sent by Mr. and Mrs Robt. J. Read, of Norwich, in whose service Ellen Baxter had been engaged upwards of five years.
